Obecná část stanoví např. působnost trestního zákoníku a obsahuje ustanovení, která jsou společná všem nebo více trestným činům, když například vymezuje vznik a zánik trestní odpovědnosti, okolnost vylučující protiprávnost, ukládání trestu, zahlazení odsouzení, definici pachatele trestného činu atd. Zvláštní část pak definuje jednotlivé trestné činy s uvedením znaků, které jsou pro konkrétní trestný čin charakteristické a čím se např. liší navzájem (rozdíl mezi loupeží a krádeží, podvodem a úvěrovým podvodem či zpronevěrou atd.).
