Je to fyzická osoba, která je u zaměstnavatele v pracovním poměru nebo se kterou sjednal zaměstnavatel dohodu o provedení práce, pokud tato dohoda zakládá podle zákona upravujícího nemocenské pojištění účast na nemocenském pojištění (měsíční odměna vyšší než 10 tisíc korun měsíčně) anebo dohodu o pracovní činnosti (měsíční odměna vyšší než 4 000 Kč, na jejichž základě jí vznikly v rozhodném období mzdové nároky nevyplacené zaměstnavatelem.
